Sales Tax & Tax Exemption Policy
Why am I being charged sales tax?
TN Nursery is required by Tennessee law to collect state and local sales tax on all retail orders shipped to or purchased within Tennessee. This applies to plants, trees, shrubs, and all tangible goods unless a valid tax exemption applies.
Who qualifies for tax-exempt purchases?
Sales tax can only be removed if the buyer provides aย valid exemption certificate issued by the State of Tennessee before or at the time of purchase. Qualifying exemptions include:
-
Resale Exemption Businesses purchasing plants strictly for resale may provide a valid Tennessee Sales & Use Tax Resale Certificate.
-
Agricultural Exemption Commercial farmers or nursery operators may qualify if they hold an active Tennessee Agricultural Sales & Use Tax Certificate of Exemption.
-
Government or Approved Nonprofits Government agencies and certain nonprofit organizations must provide official exemption documentation issued by the State of Tennessee.
Who does NOT qualify for tax exemption?
-
Homeowners, gardeners, landscapers, or hobby growers
-
Customers using plants for personal property or home projects
-
Customers without a valid Tennessee-issued exemption certificate
Can sales tax be refunded after an order is placed?
Sales taxย cannot be refunded retroactively unless a valid exemption certificate was provided at the time of purchase. Tennessee law does not allow tax removal after an order has been completed without proper documentation.
How do I submit my exemption?
Please email your exemption certificate to help@tennesseewholesalenursery.com and your phone number before placing your order. Once verified, your account will be marked tax-exempt for qualifying purchases.
